Terms of Service & EULA

Please read these Terms of Service (“Terms”, “Terms of Service”, or "EULA") carefully before using the DoulaOS platform.

These terms establish the legal binding agreement between you ("User," "Doula," "Provider," or "Client") and Indigo Tracking LLC d/b/a DoulaOS ("we," "us," or "our"). By accessing or using DoulaOS (the "Service"), you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.

1. Acceptance of Terms

By accessing, browsing, evaluating, or creating an account on DoulaOS, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement (EULA) and Terms of Service. This includes our Privacy Policy and any other agreements expressly incorporated by reference.

2. Intellectual Property & Reverse Engineering

The Service and its original content (excluding User Content), features, workflows, UI/UX designs, algorithms, and functionality are and will remain the exclusive intellectual property of DoulaOS and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Strict Prohibition of Reverse Engineering

You are strictly prohibited from utilizing DoulaOS for the purposes of competitive analysis, cloning, or reverse engineering. Specifically, you agree that you will not:

  • Copy, modify, create a derivative work of, reverse engineer, decompile, or otherwise attempt to extract the source code or UI/UX logic of the Service.
  • Create a DoulaOS account for the primary purpose of studying its interfaces, feature sets, or technical capabilities in order to build a competitive product.
  • Scrape, spider, or use automated systems to extract data, layouts, or assets from DoulaOS properties.

Breach of this clause will result in immediate termination of your account and pursuit of civil damages for intellectual property theft.

3. Data Privacy and Information Security

DoulaOS takes the security of your data seriously. We employ industry-standard encryption protocols (including TLS/SSL in transit and AES-256 at rest) to protect the personal information of our practitioners and their clients.

Data Ownership

You retain all rights to the data you upload into DoulaOS ("User Data"). DoulaOS claims no ownership rights over the health records, birth plans, or private chat messages generated between doulas and clients.

How We Use Your Data

We do not sell your data. DoulaOS only processes your data to provide, maintain, and improve the Service. In accordance with standard technology practices, we may aggregate and anonymize usage data to understand platform trends, but this data will never identify individual users or compromise private medical information.

HIPAA Disclaimer

While DoulaOS implements robust security and encryption measures designed to protect sensitive data, DoulaOS is not currently a certified HIPAA-compliant entity. Doulas acting as "Covered Entities" under U.S. law are responsible for ensuring that their use of DoulaOS complies with their specific regulatory requirements.

4. Account Responsibilities

When creating an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate information may result in immediate termination of your account.

You are entirely responsible for maintaining the confidentiality of your account credentials, including passwords and magic link access. You agree to accept responsibility for any and all activities or actions that occur under your account.

5. Medical Disclaimer

DoulaOS provides software infrastructure for doulas and pregnancy coaches. DoulaOS does not provide medical advice, diagnosis, or treatment. The "Resource Hub," "Pregnancy Journey," and any default templates provided within the platform are for informational and administrative purposes only. Clients should always seek the direct advice of their physician or qualified health provider with any questions regarding a medical condition.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOULAOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.

By using DoulaOS, you confirm that you have read, understood, and agreed to these Terms of Service.
